Update: Teacher now faces charge of intentional exposure of the AIDS virus

A teacher and track coach at HL Bourgeois High School in Terrebonne Parish is due in court today.

He was initially arrested for allegedly having a sexual encounter with a male student, and now he faces a charge of intentional exposure of the AIDS virus.

"We can establish the fact that there was an encounter that happened," Sheriff's Chief of Detectives Malcolm Wolfe said.

He says 37-year-old Derrick Nesby of New Orleans will reappear before a judge to be arraigned on this new charge.

Investigators say the teacher knew he had AIDS and did not tell the student before having sexual contact with him.

Nesby has been in jail since he was arrested on Wednesday. His bail for the previous charge was set at $500,000.

The victim in the case, is a 16 years old.

Nesby has denied the allegation that he had a sexual encounter with the teen.
