Jury can't agree on death, so it's life for killer



It's life in prison for a man the Orleans D.A. wanted to send to death row.  Jurors late Thursday night couldn't agree on the issue of the life or death for convicted killer Kenneth Barnes.  As a result, he will receive two life sentences.

The jury convicted Barnes of kidnapping Fitzgerald Phillips and Calyisse Perkins in April 2009. Police said the 25-year-old and two others robbed both of the victims' homes and then killed them at an abandoned house when the families couldn't get the ransom money demanded for the victims.

The law says that for a death penalty, all 12 jurors must unanimously agree on the sentence.

In a statement about the jury's decision, D.A. Leon Cannizzaro said, "They went above and beyond the call of duty in this case, and I truly appreciate the time and attention that they gave to it."
