NOPD decides not to charge mother of dead girl with murder, DA to decide

New Orleans Police initially announced they were booking a mother on murder charges in the death of her five-year-old daughter.

Spokeswoman Hilal Williams now says in a news release, "Pending an autopsy... this case will be reviewed by the District Attorney's Office."

Investigators have booked 28-year-old Laderika Smith with cruelty to a juvenile after he daughter's death Sunday.

"Officers responded to a child shot at a residence in the 2200 block of North Galvez Street.  Officers located the child in a bedroom suffering from a gunshot wound to the head.  The child was transported to the hospital where she later died," Williams said.  "A preliminary investigation indicates the child was home alone and had somehow come into contact with a .38 revolver and accidentally shot herself in the head."

In the initial release after the little girl died, NOPD said police were charging the mother with second degree murder.

WWL Legal Analyst Chick Foret says, "To me, it's more a situation of a negligent homicide... which is the killing of a human being by criminal negligence."

Williams said, "According to the child's mother, 28-year-old Laderika Smith, she locked her daughter inside the residence for a short period of time while she went to the store.  Upon her return, she located the child lying on the bedroom floor with a gunshot wound to the head.  Smith did confess to having a gun inside the home."
