Krisian: Saints and Brees jump the final hurdle?

ESPN’s Chris Mortensen reports that an arbitrator has ruled in favor of quarterback Drew Brees over the question of whether this year’s franchise tag is the first or second time the QB has been franchised.

What does this mean for the contract negotiations? Well, first, the nuts and bolts: The arbitration ruling reported by Mortensen means is that in the unlikely event that Brees plays under the franchise tag this year, and then plays under the franchise tag again in 2013, his guaranteed 2013 salary would be more than $23 million.

The Saints were arguing that under CBA rules, a single team could franchise a player for 3 seasons in a row.  Brees and his agent argued that the CBA rules should be read that a player could be franchised for 3 seasons, total, no matter what the team. The arbitrator sided with Brees. 

In the real world, though, this means that it clears another hurdle for both the team and Brees.  They both know where they stand now that this chess piece has been moved, and hopefully they can now finalize the contract before July 16th.

Why Does This Not Affect This Year's Cap And Salary?
If this ruling states that Drew is on his second year, why doesn't that guarantee him 120% for this year? I believe if that statement was clarified, there would be signatures on a contract by the end of the week.

Why does this not affect this year's cap and salary

It's the greater of the 2 120% of last year or average of top 5 players at position.

July 16 Clarified
The importance of the July 16 date is that is the last day a tagged player can sign a long term contract, after that date they can only sign the franchise tag offer. I believe that the first tag is the average of the top 5 players at the position, secondtag is 120% of that number (approx 19 million for Drew) and the third is 120% of that (approx 24 million). So I would expect movement sooner rather than later.

Based on the ruling Drew is due 19.7 million this year and 23 million if he is franchised next year by this ruling. Quit playing and sign him. Disgusting is what this is.

Whenever they finally sign him, it needs to come with an apology & explanation of why any responsible franchise that chose not to reward him after winning a Superbowl, would then not redo his contract a year ago like most franchises, and now drag their feet and insult the best player in the NFL until the last minute! IF the Saints had any goodwill or respect left as an organization after the Goodell media blitz nonsense, they are losing it fast by the way they are treating Brees!!!!!!!!!!!! Basically put, no Brees, no Payton...no chance. for YEARS to come, and off to LA, like Goodell would love.

Loomis owes Benson millions
Mickey could have signed Drew for $16 in 2009, $17 in 2010 and $18 in 2011. Now it'll cost $20 mil. For a five year deal, Mickey Loomis just lost Tom Benson $4 million a year or $20 Million!

Salary Cap
First it seems to me that Mr. Benson is not holding back because of greed on his part. He will ultimately pay the whole salary cap. I think he is worried that paying Brees as the highest player ever will seriously impact his limited salary cap and hurt the ability to sign other players. I respect and admire Drew for his excellence on the field and his presence in the community. He seems a nicce guy. However, to my regret, I am coming to the opinion that the contract is not signed because of unseemly pride on his par (i.e to be the highest player ever) or sheer greed on the part of his agent. Brees and Payton are without doubt the best thing that has ever happened to the Saints and perhaps our city.

Drew Brees IS a member of the New Orleans Saints, albeit a franchised member. There is no legal contact with Sean Payton now or at any point since Sean's suspension began.

I still think he and S. Payton have a plan to leave, he will just out price the Saints, may play under franchise tag. then he and the super coach will be gone. Its not about money, its about winning super bowls and the football legacy. Some of this depends on how the cowboys do this year. J.J. is about ready to pull the plug on some folks there.
